 FULL TERMS AND CONDITIONS

Participation in this Survey constitutes your deemed acceptance of the following Terms and Conditions:

1)    To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

2)    By entering, you acknowledge that each entrant has an equal chance of winning the prize and the winner will be drawn randomly.

3)    Holland Thomas & Associates Pty Ltd (ABN 62 109 614 093, “Holland Thomas” or “the Promoter”) reserves the right, at any time, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or any other aspect of this competition or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4)    The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition.

5)    In order to enter the Competition you must electronically submit one complete survey at http://www.surveymonkey.com/s/2013StaffSafetySurvey in order for entries to be valid.

6)    Entrants may enter only once and only one prize will be awarded per person.

7)    Incomplete entries will be deemed invalid.

8)    The Promoter reserves the right to amend these Terms and Conditions if this competition cannot be run as originally planned.

9)    The Competition commences on Monday 28 October 2013. Entries for the Competition close on Friday 28 February 2014 at 12 midnight AEST unless extended by The Promoter.  At its sole discretion the Promoter may extend the close date of the competition to Friday 4 April 2014 at 12 midnight AEST. Notification of an extension will be provided on its website www.hollandthomas.com.au no later than Friday 28 February 2014.

10) The draw for five individual entries to win the specified prizes will take place at Holland Thomas’ office at 32/328 Reserve Road, Cheltenham VIC 3192 on the Thursday immediately following the close of the competition at 10am AEST, and in any case will be no later than Thursday 10 April 2014 at 10am AEST.

11) The prize winner will be notified by email and their name will be published no later than Monday 14 April 2014 on the Promoter’ website www.hollandthomas.com.au. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into. Holland Thomas’s decision is final and no correspondence will be entered into.

12) Each of the first five valid entries drawn will win a double pass to Village Gold Class Cinemas valued at approximately $90 RRP.  The prize is not redeemable for cash.

13) A further draw for a prize, if unclaimed, may take place on Monday 19 May 2014 at the same time and place as the Competition draw, subject to any directions from a regulatory (or other appropriate) authority. If this Promotion is interfered with in any way, or is not capable of being conducted as reasonably anticipated, due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

a)    to disqualify any entrant; or

b)    subject to any written directions from a regulatory (or other appropriate) authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

14) The name of the winners may be published and the winners may be asked to participate in any publicity regarding the Competition.

15) The Promoter may, at its discretion, disqualify an entrant whether before or after a draw, if the entrant is from the same business, household or family of another winner.

16) The prize winners will be advised on how the prize is to be delivered and/or collected.  The prizes will only be delivered to addresses in Australia.

17) The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

18) The Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Survey, including but not limited to, the following:

a)    any technical difficulties or equipment malfunction (whether or not under the Promoter ‘s control);

b)    any theft, unauthorised access or third party interference;

c)    any entry, prize or claim for a prize that is late, lost, altered, damaged or misdirected (whether before or after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

d)    any claim that may occur connected with their participation in any prize;

e)    any variation in prize value to that stated in these Terms and Conditions;

f)     any tax liability (including FBT) incurred by a winner or entrant;

g)    use of the prize;

h)    use of or reliance on the results of the survey as published by the Promoter; and

i)      use of or reliance on the results of an individual organisation report as published by the Promoter.

19) In order to constitute a valid entry, you must provide your name and email address at Section 9 of the Survey. You may submit a response to the Survey without completing Section 9 of the Survey.

20) The Promoter will not share your personal information with any third parties unless required to do so by law. The Promoter does not sell personal information to other organisations.  Holland Thomas’ Privacy Policy is available online at: http://www.hollandthomas.com.au/privacy/

21) The Promoter collects your personal details. By providing your name and email address, you are consenting to receiving email updates on staff safety matters from Holland Thomas from time to time. You will have the option to unsubscribe from these updates. You may withdraw your consent at any time by notifying Holland Thomas at info@hollandthomas.com.au

23) Employees of the Promoter are not eligible to win any prizes.

24) All entries and any copyright subsisting in the entries become and remain the property of the Promoter and cannot be returned. The Promoter may who may publish or cause to be published any of the entries received provided that the information published is anonymous.

25) All data collected becomes the property of the Promoter.  The Promoter will not release any raw data that has been collected. All reasonable care will be taken by the Promoter in the preparation, analysis and publication of the survey results.

26) The Promoter will publish the survey results on its website www.hollandthomas.com.au

27) The Promoter will only provide raw data pertaining to an organisation upon the receipt of a request in writing by that organisation, and even then the raw data will only be provided at the sole discretion of the Promoter.

28) At its sole discretion, the Promoter will prepare an individual organisation report for organisations that have provided 30 or more responses where those respondents have all entered the same ‘Organisation Code’ at Question 1. The Promoter will only provide that individual organisation report to the representative(s) of that organisation who were invited by the Promoter to participate in the Survey.

29) The Promoter will provide the individual organisation reports to the qualifying organisations as soon as possible after the close of the competition. The Promoter does not make any representation or guarantee as to when the individual organisation report will be provided to an organisation.
